Mobile Phone Offences

Mobile phone offences include using a phone, sat nav, or any other handheld device while driving. Only the use of devices with hands-free access is permitted. This includes a built-in sat nav, dashboard holder, and a windscreen mount—as long as the device does not restrict the driver’s vision of the road.

This offence can result in penalties such as receiving 6 penalty points and a fine. New drivers, who have held their licence for less than 2 years, may have their licence revoked. Additionally, drivers can receive 3 penalty points if their view of the road is restricted.

Our solicitors are experienced and have an in-depth understanding of road traffic law. We are well-equipped to provide beneficial advice and support on this matter.

Things to Consider

  • Exceptions to this offence include: the need to call an emergency service, the driver is safely parked, making a contactless payment in a vehicle that is stationary, and using the device to park the vehicle remotely.
  • The prosecution will need to prove that the driver had a device in their hand and that they were actively using it.

How long does it take?

The timeframe for mobile phone offences varies depending on the severity of the case. Court proceedings will typically begin within six months of the date of the offence, as this is classified as a summary offence. However, the overall length of the case will depend on the specific circumstances involved.
