
Things to Consider
- You will need to apply for a new driving licence and may be required to retake your driving test if you have been disqualified for 56 days or more.
- When presenting hardship as a defence, it must qualify as exceptional hardship rather than mere inconvenience. For instance, loss of employment alone is not sufficient—there must be proof that it would significantly impact the offender or dependents.
- It is possible to apply to reduce disqualification periods after they have been imposed, but there must be valid justification such as a legal error.
How long does it take?
The severity of the charge will determine how long a driving disqualification case lasts. If the offender has prior disqualifications, the case may require more time as we will need to take the facts of each disqualification into account.
